In New Jersey, if convicted of DWI/DUI, fines, costs, and surcharges exceed $4,000 for a first offense and one's privilege to operate a motor vehicle will be suspended for a minimum of 90 days up to one year. One is also subject to a potential 30 day jail term although that is rarely imposed. There is also a requirement to attend at least 2 days of the IDRC (Intoxicated Driver Resource Center) where one can be required to perform additional aftercare. If the BAC (blood alcohol content) is above .15%, one will be required to install an interlock device on any vehicle driven by or registered to that person. An interlock is in essence a Breathalyzer that one must blow into for the car to start and continue to operate. If alcohol is detected by the interlock device while attempting to operate a vehicle, not only will the car not operate, but a report of the alcohol content is down loaded and provided to probation or law enforcement. Penalties get progressively more severe for subsequent violations for operating under the influence.
In New Jersey, unlike some other states, DWI/DUI is not a criminal offense. It is a traffic offense and as such one is not entitled to a jury trial. Trials are conducted in the municipal court before a single judge.
